Sharing With Overseas Recipients

We have chosen to Opt-in to be covered by the Privacy Act 1988.

Section 6EA of the Privacy Act allows small businesses/not-for-profits, who would otherwise not be covered by the Privacy Act, to choose to be treated as an organisation for the purposes of the Privacy Act and therefore subject to the Australian Privacy Principles (APPs) and any relevant APP code.

As such, We as an APP entity may disclose personal information to an overseas recipient without complying with APP 8.1 where the disclosure is ‘required or authorised by or under an Australian law or a court/tribunal order’ (APP 8.2(c)).
